Stakeholders familiarise selves with new decentralisation law.
Stakeholders concerned in one way or the other with the decentralization process in the country have familiarized themselves with some practical issues contained in the new law to institute the General Code on Regional and Local Authorities. The text, recall, was adopted by parliament in mid-December and promulgated into law by the Head of State on December 24, 2019.
Chaired by the Minister of Decentralization, Georges Elanga Obam, the first session of the National Committee on Local Finance for 2020, was a platform for the actors to get clarifications on certain important aspects of the laws for an effective and efficient implementation of some of the provisions on the field.
The General Code on Regional and Local Authorities incorporates some of aspects of the 2004 Law on local Authorities, which most of the stakeholders are already aware of. But the Decentralisation Minister said accent during their session was placed on the novelties of the text. “We want to ensure that all the actors have a good understanding of the innovations and the financial aspects of the law”, said Minister Elanga Obam, adding that proper understanding of key provisions of the law would enable a better and easier implementation which would go a long way in speeding up the decentralization process as a whole. Two key innovations in the law include the provision that 15% of the state budget be allocated to local councils and the putting in place of a new fiscal Regime of the state as recommended by the Economic and Monetary Community of Central Africa, CEMAC.
The Minister also gave assurances that the elaboration of the financial reports of local councils, the application text of the General Code on Regional and Local Authorities and efforts to fully hand over competences to local authorities will all be done by the National Committee on Local Finance as the year unfolds.
The General Code on Local and Regional Authorities, according to government, is intended to fast-track and deepen the decentralization process as provided for in the 1997 constitution as amended. It also believes the Law is a significant step toward meeting the critical development needs of the population of the North West and South West Regions, to which a “special status” has been conferred.
The “special status” accords certain preferences to the two English speaking Regions with respect to their linguistic peculiarity and historical heritage. The Law is made up of 501 sections, divided into seven voluminous books.
