Procedures after voting.
The Electoral code in section 108 (1) states that, “Once the time set for the close of the polis is up, the Chairperson of the Local polling Commission shall declare the close of the polls”. Section 109 of the Electoral Code provides that, “vote counting and tallying shall take place in each polling station immediately after the actual end of voting, in the presence of voters who so desire provided the hall can contain them without obstructing the counting operation”.
After the counting: Section 113 of the Code specifies that, “Once counting is over, the results obtained in each polling station shall be proclaimed”. Concerning the results, Section 115 (1) of the Electoral Code says:
“The results of the poll shall forthwith be entered into a report. Such report, which shall be made in as many copies as there are members plus two, shall be closed and signed by all the members”. According to sub section 4, “A copy of the report shall be forwarded, within 48 hours following the close of the poll, to the Chairperson of the Divisional Supervisory Commission or to the Chairperson of the Council Supervisory Commission, where necessary”.
Specifically on Council Election
Section 192 of the Electoral Code provides that, “The Council Supervisory Commission shall be responsible for the centralization, verification of the vote counts, on the basis of reports and documents forwarded by the local polling commissions. It shall, as the case may be, correct, review or cancel the said reports”.
As for the proclamation of results, section 193 (1) states that, “The Council Supervisory Commission shall proclaim the results of municipal elections in the electoral constituency concerned within 72 hours following the close of the polls”. The proceedings shall be minuted in a report and Subsection 3 specifies that, “A copy of the said report shall be forwarded to the Senior Divisional Officer of the jurisdiction for onward transmission to the Minister in charge of local and regional authorities. Another copy shall be sent to the General Directorate of Elections”.
