Mohamadou Bayero Fadil sued for bounced cheque.

No: 478

Mohamadou Bayero Fadil sued for bounced cheque.

Business magnate of CCC fame, Mohamadou Bayero Fadil, will appear before the Douala, Ndokoti Court of First Instance next Monday, 30 March 2020, to answer charges of a bounced cheque.

The CPDM Central Committee member is accused of issuing a cheque of 24 million FCFA for payment of services rendered by société Pack industry which returned unpaid because of absence of cash to the tune of that amount in the account of Holding shares incorporated, Fadil’s company.

Issuance of a bounced cheque is an offence punishable by Articles 74 and 254 of the Penal Code.

The summons, first announced by Le Messager, French Language daily, was served the defendant on 20 March 2020 by Sheriff-Bailiff attached to the Littoral Court of Appeal and Douala Courts, Me Happi Julienne.

According to Le Messager, within the framework of trade relations between société Holding shares incorporated and société Pack industry, legally represented by Ebelle Kondo Gabriel, CEO, the latter made several deliveries amounting to 24 million 897thousand and 015 FCFA , but the BICEC cheque n°3907487  issued by Fadil bounced. Since then, despite several letters written to draw the attention of the business magnate about the bungled transaction, the debtor treated the creditor with scorn, forcing the latter to go to court..

Me Michel Etia, counsel for Pack industry, told Le Messager that Mohamadou Bayero Fadil is condemned to loss of liberty as a result of the suit. He hopes the court would rule that he pays cost to Pack Industry.
