*I am a physician with specialist Interests/Competence in Internal/ Acute Medicine and Geriatrics.*
I will especially appreciate our Learned Father Ayah Paul or other gentlemen with a greater grasp of the issues raised herein.
1 - Was there any Kamerun with defined boundaries as a sovereign State recognised by the International Community of the day before 1884?
2 - Who are those who defined the borders of Kamerun at 1884...its inhabitants or the International Community?
3- Was that delimitation recognised under international law?
4 - When the borders changed with the addition of NeuKamerun in 1911...was it recognised under International Law.
5 - When the German Protectorate was divided in 1916 and confirmed in 1919, was that division recognised in International Law?
6 - Did German Kamerun cease to exist as an entity in 1919?
7 - Was there an International Boundary separating "Cameroun Sous Tutelle Francaise" from "Cameroons Under British Trusteeship"? Was this border of equal value under international law as the Border separating "Cameroun Sous Tutelle Francaise" from Tchad?
8 - When "Cameroun Sous Tutelle Francaise" became a Sovereign State called " La Republique du Cameroun" were "British Southern and Northern Cameroonians" eligible for citizenship on 1st January 1960. Were they "Camerounais" (in English "Camerounese") or not?
9 - When La Republique du Cameroun applied to join the UN in September 1960 it had to define its borders. Did its borders include Buea, Bamenda Jakiri, Mamfe?
9 - Let's come to the plebiscite.. What was the offer the Federal Republic of Nigeria made to the Southern Cameroons if she had decided to "join" Nigeria?
10 - Following the offer made by Nigeria , what was the offer made by the "La Republique du Cameroun" if the Southern Cameroons ( let' s limit ourselves to just the Southern Cameroons for now) decided to " join" it?
11- Do you know that in Law and International Relations words can have a meaning different from their everyday usage.
12 - Do you know that the word "join" was adequately defined by both Ahidjo and Foncha in a 5 page document published by the Southern Cameroons Gazette in August 1960. Do YOU understand that "Join" never meant " become an integral part of" as defined in this document and submitted to the UN. Francophones generally do not know this.
13 - Do you know that "Join" meant to associate as a Federation of Two Equal States as per International Law.
14 - Do you know that the SOUTHERN CAMEROONS QUESTION WAS THE SUBJECT OF THREE VOTES ON THE 21ST OF APRIL 1961 AT THE UN?
Let me tell you the questions asked.
(i) - Should the Trusteeship be terminated?
(ii) - Should Southern Cameroons achieve Independence?
(Iii)- Should Southern Cameroons on achieving Independence UNITE with the Republic of Cameroun to form the Federal United Republuc of the Cameroons?
15 - Do you know that 60 Nations of the World voted YES to the question "Should Southern Cameroons achieve independence?"(UNGA Vote number (ii) WHILE 23 Nations VOTED AGAINST. WHICH VOTE WON?
16 - DO YOU KNOW THAT AMONGST THE COUNTRIES THAT VOTED "NO" to the UNGA RESOLUTION 1608 VOTE(ii) was a certain " Republique du Cameroun"? What does this tell you? Does this not answer the question whether Southern Cameroons achieved Independence?
17 - Why did LRC vote AGAINST the Independence of the Southern Cameroons while knowing that Independence had already been linked to UNION?
18 - DO YOU KNOW THAT FRANCE AND ALL FORMER FRENCH COLONIES WITH THE EXCEPTION OF MALI VOTED "NO"?
19- DO YOU KNOW THAT REGARDING UNITING WITH LRC THE USA VOTED " ABSTENTION"?
20 - Do you understand that after the Federal Unification "la Republique du Cameroun" ceased to exist as a Sovereign State and the Sovereignty was transferred to "La Republique Federale du Camerounl" which was an Aggregative Federation of Two Equal States?
Did you know that Article 1 of the Federal Constitution said after the Union "la Republique du Cameroun " changed its name to "Cameroun Oriental".
21 - Do you know the difference between an Aggregative Federation like the Federal Republic of Cameroon was and a SEGREGATIVE FEDERATION such as Nigeria, USA, Brazil.
22 - Do you know that the referendum of 20th May 1972 to change from a Federation of Two Equal Sates to a Unitary Centralised State was in violation of the federal Constitution so will be null and void in any international Court. It violated Article 47.
23 - You mentioned that there were many Nigerians in the Southern Cameroons. Do you know that there were many Camerounese too. And both Nigerians and Canerounese were not allowed to vote. Only subjects of the Southern Cameroons by virtue of Settlement and/or Birth as defined by the Southern Cameroons Order in Council (CONSTITUTION) of 1st October 1960 were allowed to vote.
24 - If the Southern Cameroons was a de facto or de jures part of "La Republique du Cameroun" .. why was it not just reattached instead of a Referendum?
25 - You mentioned the offer made to Northern Cameroons, do you know that a VERY DIFFERENT OFFER WAS MADE TO THE SOUTHERN CAMEROONS. Northern Cameroons was to be integrated into the Federal Northern Region of Nigeria while Southern Cameroons was to BECOME THE FOURTH FEDERATED REGION. Do you know that it was because of this very attractive offer that LRC had to step up and offer a UNION OF TWO EQUAL STATES.
26 - The Constitution of LRC said it was "une Republique Unie et Undivisible". That's OK for you guys as it was photocopied from the French Constitution. Do you know that at the Foumban Conference ALL THE DELEGATES FROM THE SOUTHERN CAMEROONS OBJECTED TO THIS PHRASE BEING INCLUDED IN THE FEDERAL CONSTITUTION ? The federal constitution NEVER SAID " la Republique Federale du Cameroun est une et indivisible"..Why?
27 - DO YOU KNOW THAT THE FEDERAL REPUBLIC OF CAMEROON NEVER SUBMITTED TO THE UN A DECLARATION OF MODIFICATION OF ITS BORDERS TO INCLUDE THE SOUTHERN CAMEROONS? Reason for which Biya was handed Two Maps of the Two Cameroons au "Cinquantenaire de la Reunification"
28 - DO YOU KNOW THAT WHAT YOU PEOPLE CALL REUNIFICATION was in fact “UNIFICATION" SOUS FORME FEDERALE" THE Banner in Foumban said " VIVE LE CAMEROUN UNIFIE". ( Google and check)
29 - Do you know that there were so many points of disagreement at the Foumban Conference that it was understood other conferences will follow to iron them out but they never happened.
30 - Do you know that the Federal Constitution had to be voted and ratified by The Two Assemblies of the Two States before it became binding? Do you know it was NEVER SUBMITTED TO OR VOTED BY THE SOUTHERN CAMEROONS PARLIAMENT?
31 - DO YOU KNOW THAT THE SOUTHERN CAMEROONS AND LRC HAD TO SIGN A UNION TREATY TO RATIFY THE UNION AND DEPOSIT A COPY AT THE UNITED NATIONS. DO YOU KNOW NO TREATY WAS EVER SIGNED UP TILL THIS DAY?
32 - Without a legal document can't it best be said LRC and the SOUTHERN CAMEROONS BEGAN but did NOT terminate the UNION?
33 - IN THE ABSENCE OF A LEGAL DOCUMENTS, CAN SOUTHERN CAMEROONIANS WHO DO NOT WANT THIS UNION...SHOULD THEY BE CALLED SECESSIONISTS?
34 - Do you realise your error when you said "The Federal Cameroun became the Republic of Cameroon in 1972". That is wrong. The Federal Republic of Cameroon became " the UNITED REPUBLIC OF CAMEROON" by an anti-constitutional referendum in 1972 and not " the Republic of Cameroon"
35 - Do you know the Name and Entity called "la Republique du Cameroun" ceased to EXIST LEGALLY WHEN IT FEDERATED WITH SOUTHERN CAMEROONS. IT LOST ITS SOVEREIGNTY and became a Federated State called East Cameroon.
36 - Do you know that the Southern Cameroons achieved Autonomy and Self-Government in 1954 THREE YEARS BEFORE CAMEROUN SOUS TUTELLE FRANCAISE under Andre Marie Mbida.
37 - DO YOU KNOW THAT THE FIRST EVER PEACEFUL TRANSFER OF POWER IN BLACK AFRICA WHERE A SITTING GOVERNMENT ORGANISED AN ELECTION AND LOST AND HANDED POWER TO THE OPPOSITION WITHOUT STRIFE OR VIOLENCE TOOK PART IN SOUTHERN CAMEROONS IN FEBRUARY 1959. What does that tell you of the democratic traditions of the Southern Cameroons?
38 - PAUL BIYA resurrected the defunct " La Republique du Cameroun" in February 1984 when he changed the name from " United Republic of Cameroon" to the name "Republique du Cameroun" which was the official name under International Law of ONLY THE PREVIOUS FRENCH CAMEROUN WHEN IT BECAME INDEPENDENT. What happened to Southern Cameroons? At least the name "United Republic of Cameroon" created an impression of a unitary State made up of two former parts. Why thisname change?
39- Under International law governing the creation and extinction of States do you know that by resuscitating a defunct component of the UNION ("la Republique du Cameroun") YOU AUTOMATICALLY AND SIMULTANEOUSLY RESUSCITATE THE OTHER DEFUNCT PART OF THE UNION TOO (The Southern Cameroons). That is a binding principle in International relations. ARE WE NOT THEREFORE RIGHT IN AFFIRMING THAT SOUTHERN CAMEROONS HAS A LEGAL EXISTENCE SINCE FEBRUARY 1984?
( YOU SEE WHY SISSIKU AND Co affirmed clearly
that they ARE NOT CAMEROONIANS).
40 - Since you guys like to accuse SOUTHERN CAMEROONIANS WHO AFFIRM THEIR RIGHT TO STATEHOOD AS "SECESSIONISTE".. ARE WE NOT RIGHT IN SAYING THAT BY DECREE NO 001/84 OF 4TH FEBRUARY 1984, by resurrecting " La Republique du Cameroun" PAUL BIYA IS THE SECESSIONIST AS HE SECEEDED FROM THE UNION .
There are other points I could make but let's stop here for now.
In a future hearing at any International Court.. LRC stands no chance. Reason for which they resort to violence. We joined you guys after a peaceful referendum. Why not re-organise one with the option of the right to sovereignty and see. Tchiroma said separatists are a minority noorr. Organise a Referendum and we will accept the outcome. From all the above, you will discover that the case for the independence and full sovereignty of the Southern Cameroons is rock solid legally. We just need the geopolitics to realign itself and we will have it on a plate. We are not mad men. Michel Bien Tong went to prison for enlightening Francophones who generally are ignorant of these findings. That’s how the barbaric LRC functions.. violence, repression and electoral engineering...
You guys are seriously infected with a POLITICAL EBOLA VIRUS OF THE WORST KIND. FOR OUR OWN SANITY AND SELF-PRESERVATION, FOR THE SAKE OF OUR CHILDREN.. WE THE PEOPLES OF THE SOUTHERN CAMEROONS HAVE ACTIVATED THE DISSOLUTION OF THIS INCOMPLETE UNION AND NOTHING WILL HOLD US BACK. It is just a matter of time. We will achieve it. JUSTICE AND TRUTH ARE ON OUR SIDE. THANKS
